{"id":281,"date":"2021-03-29T18:00:12","date_gmt":"2021-03-29T21:00:12","guid":{"rendered":"https:\/\/habeasdata.kgvlaw.com.br\/?p=281"},"modified":"2021-03-29T18:00:12","modified_gmt":"2021-03-29T21:00:12","slug":"anpd-assina-relevante-acordo-de-cooperacao-tecnica-com-senacon","status":"publish","type":"post","link":"https:\/\/habeasdata.kvlaw.com.br\/en\/anpd-assina-relevante-acordo-de-cooperacao-tecnica-com-senacon\/","title":{"rendered":"ANPD SIGNS RELEVANT TECHNICAL COOPERATION AGREEMENT WITH SENACON"},"content":{"rendered":"<p><\/p>\n<p style=\"text-align: justify;\">Last Monday (March 22, 2021), the National Data Protection Authority (&#8220;<u>ANPD<\/u>&#8220;) and the National Consumer Secretariat (&#8220;<u>Senacon<\/u>&#8220;) signed a technical cooperation agreement destined for protecting consumer data.<\/p>\n<p style=\"text-align: justify;\">The agreement provides that, on the one hand, Senacon will share with ANPD the aggregate and statistical data information collected from consumer complaints related to the protection of personal data, especially those registered in SENACON&#8217;s platforms, such as Sistema Nacional de Informa\u00e7\u00f5es e Defesa do Consumidor (\u201c<u>Sindec<\/u>\u201d) and Consumidor.gov.br.<\/p>\n<p style=\"text-align: justify;\">On the other hand, the ANPD will provide, when formally requested, information and clarification regarding the rules issued by ANPD that affect the interests of consumers and will clarify, in case of doubt, the ANPD&#8217;s position regarding the interpretation and application of such rules related to the personal data protection that, in any way, affect the interests of consumers.<\/p>\n<p style=\"text-align: justify;\">With this partnership, the agencies intends to promote joint actions in the areas of data protection and consumer protection, through the exchange of information, standardization of understandings, cooperation on enforcement actions, development of education, training and preparation of studies and research.<\/p>\n<p style=\"text-align: justify;\">The partnership between the agencies has great potential to speed up investigations related to consumer complaints and the actions of public authorities in protecting citizens&#8217; rights.<\/p>\n<p style=\"text-align: justify;\">In addition, the partnership helps to provide the ANPD with information about possible infractions, incidents, and data breaches, since it establishes an effective communication channel between these governmental bodies.<\/p>\n<p style=\"text-align: justify;\">As stated by the President of ANPD, Waldemar Gon\u00e7alves, this agreement is &#8220;a milestone for Brazil&#8221; and shows that the ANPD has been actively working to establish a data protection culture in Brazil.<\/p>\n<p style=\"text-align: justify;\">Also, according to the President of the ANPD, at this time, the agency &#8220;does not have a punitive spirit, but one of education and culture change, to show companies that respect for consumer data is very important.&#8221;<\/p>\n<p style=\"text-align: justify;\">This agreement is part of the ANPD&#8217;s Strategic Planning to promote the establishment of the Data Protection culture and can be fully accessed <a href=\"https:\/\/www.gov.br\/anpd\/pt-br\/acesso-a-informacao\/arquivos\/acordo_anpd_senacon_assinado.pdf\">here<\/a>.<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\"><em>This article is intended exclusively to provide information and does not contain any opinion, recommendation or legal advice from KGV Advogados concerning the matters herein addressed.
